Terms of Service

Effective Date: March 4, 2026  ·  Last Updated: March 4, 2026

Please read carefully. By accessing or using this website, you agree to be bound by these Terms of Service. If you do not agree, please do not use this Site.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website located at ashmont.insure (the "Site") and any services provided by Ashmont Insurance Agency LLC ("Ashmont," "we," "our," or "us"). By accessing the Site or using our services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Brokerage Relationship

Ashmont Insurance Agency LLC is a licensed insurance broker. We act as an intermediary between you (the insurance buyer) and third-party insurance carriers. We are not an insurance company and do not underwrite, guarantee, or provide insurance coverage directly.

  • Insurance quotes obtained through this Site are estimates only and are subject to underwriting review and approval by the relevant carrier.
  • Final policy terms, conditions, exclusions, and premiums are determined solely by the insurance carrier.
  • Coverage is not bound or effective until confirmed in writing by the insurer.

3. Not Legal or Financial Advice

The information, content, and tools provided on this Site are for general informational purposes only and do not constitute legal, financial, tax, or professional advice. You should not rely solely on information provided here when making coverage decisions. We recommend consulting with a qualified professional regarding your specific business needs.

4. Eligibility

This Site is intended for use by business owners and representatives located in the United States who are seeking commercial insurance. By using this Site, you represent that you have the legal authority to bind the business entity on whose behalf you are acting and that all information you provide is accurate and complete.

5. Accuracy of Information

You agree to provide accurate, current, and complete information when using our services. Providing false or misleading information in connection with an insurance application may constitute fraud, void any coverage obtained, and expose you to legal liability. We reserve the right to refuse service to anyone providing inaccurate information.

6. Permitted Use

You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law or regulation;
  • Transmit unsolicited communications, spam, or malicious code;
  • Attempt to gain unauthorized access to any portion of the Site or its related systems;
  • Reproduce, duplicate, sell, or exploit any portion of the Site without express written permission from Ashmont;
  • Use automated tools (bots, scrapers, crawlers) to access the Site without prior written consent.

7. Intellectual Property

All content on this Site — including text, graphics, logos, images, and software — is the property of Ashmont Insurance Agency LLC or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

8. Third-Party Links & Services

Ashmont does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party site. Your use of any linked site is at your own risk.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. ASHMONT DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASHMONT INSURANCE AGENCY LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THIS SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from or related to these Terms or your use of the Site shall not exceed the greater of (a) the amount you paid Ashmont in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Ashmont Insurance Agency LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any false or misleading information you provide.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the Site shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Site.

14. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to Ashmont, our users, or third parties.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
